4. User Responsibilities

As a user of InboxIQ, you are responsible for:

  • Obtaining proper consent from all email recipients
  • Maintaining accurate and up-to-date contact lists
  • Including clear unsubscribe mechanisms in all marketing emails
  • Honoring unsubscribe requests immediately
  • Complying with CAN-SPAM, GDPR, and other applicable regulations
  • Implementing proper email authentication (SPF, DKIM, DMARC)
  • Monitoring bounce rates and complaint rates
  • Securing your account credentials
  • Reporting any unauthorized access immediately

5. Account Registration and Security

When creating an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to verify your identity and business legitimacy before approving your account for production use. This may include requesting business registration documents, website verification, or other proof of legitimate operations.

6. Pricing and Payment

Pricing for our services is available on our website and may be updated from time to time. You agree to:

  • Pay all fees associated with your account and usage
  • Provide valid payment information
  • Accept that fees are non-refundable except where required by law
  • Understand that we may suspend service for non-payment

7. Service Level and Availability

While we strive to maintain 99.99% uptime, we do not guarantee uninterrupted service. We reserve the right to perform scheduled maintenance and may experience occasional downtime. We are not liable for any losses resulting from service interruptions.

  • Upon termination, you remain responsible for all outstanding fees

11. Limitation of Liability

InboxIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold InboxIQ harmless from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of third parties.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or through our platform. Your continued use of InboxIQ after such changes constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any disputes shall be resolved in the courts of Zimbabwe.
